Terms & Conditions
Effective date: 1 October 2026
Welcome to Jamjamia. These Terms & Conditions ("Terms") are a binding agreement between you and an independent developer based in Tel Aviv, Israel, the operator of Jamjamia ("Jamjamia", "we", "us" or "our"). They govern your access to and use of the Jamjamia app and website (together, the "Service"), a collaborative tool for creating, sharing and viewing chord sheets and jamming together in bands. By creating an account or using the Service, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who we are
The Service is operated by an independent developer based in Tel Aviv, Israel. You can reach us at support@jamjamia.com.
2. Eligibility & age
You must be able to form a legally binding contract to use the Service. The Service is not directed to children under 16. If you are between the minimum age of digital consent in your country and 18, you may use the Service only with the consent and supervision of a parent or guardian who agrees to these Terms on your behalf. You are responsible for all activity that happens under your account.
3. Your account
You sign in with Google. You are responsible for maintaining the security of the Google account you use and for all activity that occurs through your access. Notify us promptly of any unauthorised use. You may stop using the Service at any time and request deletion of your account by contacting us or using in-app controls where available.
4. Your Content and who owns it
You may add songs, chord sheets, lyrics, arrangements, notes, images, band information and other material to the Service ("Your Content"). As between you and us, you retain all ownership of Your Content. We do not claim ownership of it.
So that we can operate the Service for you, you grant us a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, copy, reproduce, adapt (for example, to transpose or reformat), transmit, and display Your Content, solely for the purpose of providing, maintaining, securing and improving the Service and making Your Content available to the bands and members you choose to share it with. This licence ends when you delete Your Content or your account, except for content already shared with bandmates who retain their own copies, back-ups kept for a limited period, and anything we must retain by law.
5. Your responsibility for content and rights (important)
You are solely responsible for Your Content and for the consequences of adding or sharing it. By adding Your Content, you represent and warrant that:
(a) you own Your Content or have obtained all rights, licences, consents and permissions necessary to add it and to share it with your bands through the Service;
(b) Your Content, and our use of it as permitted above, does not and will not infringe or violate any copyright, trademark, moral right, privacy right, publicity right or any other right of any person or entity, and does not breach any licence terms that apply to it (including the terms of any Creative Commons or other open licence);
(c) Your Content does not contain anything unlawful, defamatory, infringing or otherwise in breach of these Terms.
Musical works, lyrics and chord arrangements are frequently protected by copyright owned by songwriters, publishers or other rights holders. It is your responsibility, not ours, to ensure you have any rights or licences needed before adding or sharing such material. If you are unsure whether you have the right to use something, do not add it.
6. Jamjamia is a neutral tool
Jamjamia is a neutral hosting and collaboration tool. Your Content is created and shared by users, not by us. We do not create, pre-screen, monitor, verify, endorse or control Your Content, and we are not responsible or liable for it or for any loss or damage resulting from it. Any reliance you place on user content is at your own risk. We have no obligation to monitor content, but we may review, remove, restrict or disable access to any content, at any time and at our discretion, including content we believe violates these Terms or the law.
7. Copyright complaints & takedown policy
We respect intellectual property rights and expect our users to do the same. If you believe content on the Service infringes your copyright, send a written notice to terms@jamjamia.com that includes: (i) your name and contact details; (ii) identification of the copyrighted work you claim is infringed; (iii) identification of the material you claim is infringing and enough information for us to locate it; (iv) a statement that you have a good-faith belief the use is not authorised by the rights holder, its agent or the law; (v) a statement, made under penalty of perjury where applicable, that the information is accurate and that you are the rights holder or authorised to act on their behalf; and (vi) your signature (electronic is fine).
On receiving a valid notice, we will act expeditiously to remove or disable access to the material. Where a user believes their content was removed in error, they may submit a counter-notice with equivalent information, and we may restore the content if appropriate. We terminate the accounts of users who repeatedly infringe the rights of others. We may forward complaints (including your contact details) to the user who provided the content.
8. Acceptable use
You agree not to use the Service to: break any law or regulation; infringe or violate the rights of others; upload viruses or malicious code; gain unauthorised access to accounts, systems or data; scrape, reverse-engineer or overload the Service; impersonate others; harass, threaten or abuse anyone; or use the Service in any way that could damage, disable or impair it. We may suspend or remove accounts or content that violate these Terms.
9. Bands & membership
Bands have owners, admins and members. Owners and admins can invite, approve and remove members, and manage or delete the band. Invites may require approval and can expire. Content added to a band is visible to that band's members. If a band is deleted, its songs and data are removed for its members. You are responsible for what you choose to share and with whom.
10. Subscriptions & billing
Parts of the Service are offered under free and paid plans. If you buy a paid plan:
(a) Fees and renewal. You agree to pay the fees shown at purchase. Subscriptions renew automatically for the same period at the then-current price unless you cancel before the renewal date.
(b) Payment processing. Payments are handled by third-party payment processors (for example, Polar or the Apple App Store / Google Play). We do not store your full card details. Your purchase may also be subject to the processor's or app store's terms.
(c) Cancellation. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
(d) Refunds. Except where required by law or by the applicable app store's policy, payments are non-refundable and there are no refunds or credits for partial periods or unused features.
(e) Price changes. We may change prices or plan features; we will give reasonable notice, and changes apply from your next billing period.
(f) Taxes. Fees are exclusive of taxes unless stated otherwise; you are responsible for any applicable taxes.
Your statutory consumer rights, where they apply, are not affected by this section.
11. Beta and automatically generated features
Some features (such as automatic chord detection and AI-assisted chord generation) are provided on an experimental basis and may produce inaccurate or incomplete results. They are provided for convenience only, without any guarantee of accuracy, and you should verify results before relying on them.
12. Third-party services & content
The Service links to and integrates third-party services (such as Google, Spotify, YouTube and Apple Music) and may display album artwork retrieved from third-party APIs (such as Apple's iTunes Search API) and stock imagery (such as Unsplash). Those services and content are governed by their own terms and privacy policies, and we are not responsible for them or for any content, products or services they provide.
13. Service provided "as is"
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties or conditions of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or that the Service will be uninterrupted, secure, error-free, or free of harmful components. You use the Service at your own risk.
14. Limitation of liability
To the maximum extent permitted by law, an independent developer based in Tel Aviv, Israel, and its owners, employees and suppliers, will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your use of (or inability to use) the Service or any user content, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the liability, or (b) US$100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law (such as, in some jurisdictions, liability for death or personal injury caused by negligence, fraud, or a consumer's non-excludable statutory rights).
15. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless an independent developer based in Tel Aviv, Israel and its owners, employees and suppliers from and against any claims, demands, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content; (b) your use of the Service; (c) your breach of these Terms or of any law; or (d) your violation of the rights of any third party, including any intellectual property or privacy right.
16. Suspension & termination
You may stop using the Service and delete your account at any time. We may suspend, restrict or terminate your access to the Service, or remove content, at any time — including if you breach these Terms, if required by law, to protect the Service or other users, or if we discontinue the Service. On termination, the licences you granted end (subject to Section 4), and sections that by their nature should survive (including Sections 4–7 and 13–17) will continue to apply.
17. Governing law & disputes
These Terms are governed by the laws of the State of Israel, without regard to its conflict of laws rules, and the competent courts of Tel Aviv-Jaffa, Israel, will have exclusive jurisdiction over any dispute — except that this does not deprive you of the protection of any mandatory consumer-protection laws of your country of residence, and you may be entitled to bring proceedings there. To the extent permitted by applicable law, you and we agree that any dispute will be resolved on an individual basis and waive any right to participate in a class or representative action.
18. Our intellectual property
The Service itself — including the Jamjamia name, logo, software, design, user interface, the chord library and diagrams we provide, and all related content we create (but excluding Your Content) — is owned by an independent developer based in Tel Aviv, Israel or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose while you comply with these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from any part of the Service, or use our name or branding, without our prior written permission.
19. General
Changes. We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you in the app. Continued use of the Service after changes take effect means you accept the updated Terms.
Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
Severability & waiver. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not transfer your rights under these Terms without our consent; we may assign these Terms in connection with a merger, acquisition or sale of assets.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
